WeHicle Terms and Conditions

Effective Date: August 1, 2025

These Terms and Conditions ("Terms") constitute a legally binding agreement between WeHicle Sdn. Bhd. ("WeHicle," "we," "us," or "our") and you ("User," "you," or "your") governing your use of the WeHicle platform, services, and any vehicles subscribed through WeHicle. By accessing or using WeHicle, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using our services.

1. Definitions

1.1 Account: Your registered profile on the WeHicle platform.

1.2 Vehicle: The car or motorcycle made available for subscription through WeHicle.

1.3 Subscription: The fixed-term agreement for the use of a Vehicle.

1.4 User: Any individual or entity registered on the WeHicle platform.

1.5 Vehicle Provider: The third-party entity providing the Vehicle for subscription.

1.6 Platform: WeHicle's website, mobile application, or any other digital interface.

1.7 Security Deposit: A refundable deposit equivalent to two (2) months of Subscription Fees, payable upon approval of your Subscription.

1.8 Service Fee: A non-refundable fee of 10% applied to all transactions, excluding the Security Deposit.

2. Eligibility

2.1 To use WeHicle, you must:

  • Be at least 21 years of age.
  • Hold a valid driver's license recognized in Malaysia.
  • For foreign nationals, possess a valid International Driving License.
  • Have the legal capacity to enter into a binding contract.

2.2 By creating an Account, you represent and warrant that all information provided is accurate, complete, and up-to-date. WeHicle reserves the right to verify your identity, driving record, and residential address at any time.

3. Account Creation

3.1 To create an Account, you must provide:

  • Proof of identity (e.g., NRIC, passport)
  • Proof of residential address (e.g., utility bills, bank statements)
  • Proof of income (e.g., pay slips, EPF statements, or salary slips)
  • Proof of a valid driving license (e.g., a copy of your driver's license or International Driving License)
  • Emergency contact details

3.2 You consent to WeHicle contacting your emergency contact:

  • In the event of an emergency
  • If you are unreachable for an extended period

3.3 You agree to update your Account information promptly if any changes occur.

4. Subscription Process

4.1 To subscribe to a Vehicle:

  • Select a Vehicle, Subscription plan, and mileage package on the Platform
  • Submit required documentation for verification

4.2 Upon approval, you agree to:

  • Provide a Security Deposit equivalent to two (2) months of Subscription Fees
  • Pay a 10% Service Fee on all transactions (excluding the Security Deposit)

4.3 The Vehicle will be ready for collection anytime within fourteen (14) business days, depending on the readiness of the car (whether new or used) and subject to new car registrations and documentation processes.

5. Telematics Device

5.1 A telematics device will be installed in the Vehicle for safety and tracking purposes. This device collects data such as:

  • Vehicle location
  • Mileage
  • Driving behavior (e.g., speed, braking, acceleration)

5.2 The data collected by the telematics device is used solely for:

  • Ensuring the safety and security of the Vehicle
  • Monitoring driving behavior to promote safe driving practices
  • Calculating Excess Mileage Fees (if applicable)

5.3 The data is highly confidential and will not be shared with any third party unless:

  • Required by law or requested by authorities
  • Requested by the User for specific purposes (e.g., insurance claims)

5.4 You agree not to tamper with, disable, or remove the telematics device during the Subscription period. Any tampering will result in penalties, including termination of the Subscription.

6. User Responsibilities

6.1 You agree to:

  • Use the Vehicle in compliance with all applicable laws and regulations
  • Maintain the Vehicle in good condition, excluding reasonable wear and tear
  • Notify WeHicle immediately of any accidents, damage, or mechanical issues
  • Pay all fees, including Subscription Fees, Excess Mileage Fees, fines, and penalties

6.2 You are prohibited from:

  • Modifying, customizing, or altering the Vehicle in any way
  • Using the Vehicle for commercial purposes (e.g., ridesharing, deliveries)
  • Allowing unauthorized individuals to operate the Vehicle
  • Driving the Vehicle outside Malaysia without prior written consent from WeHicle

6.3 You declare and agree that:

  • Any criminal offense or illegal activity committed during the Subscription is solely your responsibility
  • WeHicle and the Vehicle Provider are not liable for any consequences arising from such offenses or activities

7. Fees and Payments

7.1 You agree to pay:

  • Monthly Subscription Fees as outlined in your Subscription plan
  • Excess Mileage Fees for mileage exceeding your selected package
  • A 10% Service Fee on all transactions (excluding the Security Deposit)

7.2 All payments are due on the invoice date. Failure to make payment within 7 days from the invoice date or cycle date may result in:

  • Suspension or termination of your Subscription
  • Recovery of the Vehicle by WeHicle
  • Additional fees, including late payment charges and recovery costs

7.3 You expressly consent to WeHicle charging your registered payment method at any time for any valid outstanding fees, including but not limited to:

  • Subscription Fees
  • Excess Mileage Fees
  • Fines, summons, or penalties
  • Accident Fees or repair costs

8. Insurance Coverage

8.1 The Vehicle is covered under a comprehensive car insurance policy, which includes coverage for:

  • Damage to the Vehicle
  • Third-party liability
  • Theft or loss of the Vehicle

8.2 You are responsible for paying any deductibles or excess fees as required by the insurance policy.

9. Accidents and Damage

9.1 In the event of an accident or damage to the Vehicle, you must:

  • Not leave the scene of the accident
  • Immediately notify WeHicle and the relevant authorities
  • Obtain a police report when required
  • Collect all necessary information from involved parties
  • Take photographs of the damage and accident scene

9.2 If the insurance claim for the accident is unsuccessful, WeHicle will cover the repair costs. However, you remain liable for the Accident Fee, as determined by WeHicle, to cover administrative expenses.

9.3 For accident repairs:

  • WeHicle, as the service provider, is allowed 1.5 months of repair time without proration of Subscription Fees. During this period, your Subscription remains active, and you must continue paying the Subscription Fees.
  • No replacement Vehicle will be provided during the 1.5-month repair period.
  • If the Vehicle is not repaired within 1.5 months, you may:
    • Swap to another available Vehicle, subject to availability and applicable fees.
    • Terminate your Subscription, subject to a termination penalty equivalent to two (2) months of Subscription Fees.

10. Repairs Due to Wear and Tear or Manufacturer Issues

10.1 For repairs required due to wear and tear or manufacturer-related issues (not caused by the User or any third party, as confirmed by the service center or workshop):

  • WeHicle is allowed 5 days of repair time without proration of Subscription Fees
  • If the repair exceeds 5 days, Subscription Fees will be prorated from the day the Vehicle is collected by the User

11. Termination and Cancellation

11.1 You may cancel your Subscription at any time by providing at least 14 days written notice to WeHicle. Upon cancellation, the following fees apply:

  • A cancellation fee equivalent to two (2) months of Subscription Fees
  • A restoration fee for any damage to the Vehicle (if applicable)
  • Forfeiture of your Security Deposit
  • Payment of any outstanding fees, including fines, summons, and applicable charges

11.2 WeHicle may terminate your Subscription immediately if:

  • You breach these Terms
  • You fail to make timely payments
  • You engage in prohibited activities as outlined in Section 6.2

11.3 All cancellations, whether initiated by the User or WeHicle, will result in the applicable penalties as outlined in these Terms.

12. Vehicle Inspection

12.1 The Vehicle will be inspected during collection and return. The condition of the Vehicle will be documented and signed by both the User and WeHicle.

12.2 No disputes regarding the Vehicle's condition will be entertained after 3 days from the handover.

12.3 You will bear all restoration charges for any damages identified during the Subscription period.

13. Roadside Assistance

13.1 WeHicle provides 24/7 roadside assistance, which includes:

  • Flat tire replacement
  • Car towing
  • Battery jump-start services

14. Subscription Inclusions

14.1 Your Subscription includes:

  • Normal wear and tear and scheduled maintenance
  • Comprehensive car insurance
  • Road tax

15. Force Majeure

15.1 WeHicle shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, or other force majeure events.

15.2 In the event of a force majeure, WeHicle will make reasonable efforts to resume services as soon as possible.

16. Dispute Resolution

16.1 In the event of a dispute, both parties agree to first attempt to resolve the matter amicably through negotiation or alternative dispute resolution methods before resorting to legal proceedings.

16.2 If the dispute cannot be resolved amicably, it shall be submitted to the exclusive jurisdiction of the courts of Malaysia.

17. Data Privacy

17.1 WeHicle complies with the Personal Data Protection Act 2010 (PDPA). By using our services, you consent to the collection, use, and disclosure of your personal data as outlined in our Privacy Policy.

18. Amendments

18.1 WeHicle reserves the right to modify these Terms at any time. Changes will be effective upon posting on the Platform. Your continued use of WeHicle constitutes acceptance of the amended Terms.

19. Miscellaneous

19.1 Entire Agreement: These Terms constitute the entire agreement between you and WeHicle and supersede all prior agreements or understandings.

19.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19.3 Waiver: Failure by WeHicle to enforce any provision of these Terms shall not constitute a waiver of such provision.
